$900 stimulus payment hangs in the balance

The law lecturer who initiated a High Court challenge to the Federal Government's tax bonus told its seven judges yesterday that a $900 tax rebate would have been legally valid, but a one-off cash payment of the same amount was not.

Bryan Pape, a states-rights advocate, barrister and University of New England academic, said the case had "nothing to do with the merits or demerits" of the Government's attempt to stimulate economic activity.

He wanted the court to rule on whether the bonus was the latest in a 20-year string of Commonwealth spending programs that "branched out into lots of new fields of activity," previously the domain of the states.

Mr Pape, who represented himself, produced a list of tax rebates and surcharges introduced in the 1960s to address an economic slowdown and subsequent boom, which he said were a valid use of the Commonwealth's taxation power.

"There are many things the taxation laws do to stimulate the economy," he said.

But the bonus was a gift, not a tax measure, and the Commonwealth did not have a general power to spend money on gifts, he said.

The constitution limited its spending to the 39 powers listed in section 51 of the constitution, such as external affairs and interstate trade, he said.

If that were not right, "there's really not much work for the constitution to do".

The chief justice, Robert French, suggested that if the bonus did not fall under one of the 39 powers in section 51, it might be a valid use of executive authority.

"And that gets us to the question: Does the executive power extend to giving money to people?" he asked.

Mr Pape replied that it did not. He argued that the Commonwealth's power to appropriate money from consolidated revenue under sections 81 and 83 of the constitution did not mean it could spend it for whatever purpose it chose.

Justice Bill Gummow asked Mr Pape how much power those sections gave the executive.

"Whether it [the executive] has power to spend it, having got it into the bank, I imagine one looks somewhere else in the constitution," Justice Gummow said.

"[Sections] 81 and 83 are about the relationship between the executive and the Parliament, not between Parliament and the public," he said.

"That's right," Mr Pape replied.

The court will hear defences of the bonus today from lawyers for the Commonwealth, NSW, Western Australia and South Australia.

The Federal Government plans to give $7.7 billion to 8.7 million taxpayers on Monday.

ATMs filled for $900 payment

The Tax Office and the Reserve Bank are making sure there is extra cash in bank machines when the $900 stimulus payments start flowing.

And they are checking that Australia Post and the government printer have the resources to produce and mail all payment cheques.

At a parliamentary committee yesterday the Tax Commissioner, Michael D'Ascenzo, confirmed that the logistics were in place to ensure the tax payments, due to start next Monday, would be on time.

Mr D'Ascenzo said the Tax Office had overspent its general budget by $80 million this year.

I don't understand why this guy is having such a problem with this payment? He is getting something out of it and he still isn't happy! I believe that it would be stupid to stop payments when they have already been promised and given out to families and students! Do they have to return the $900 to the government! He doesn't realise how this will affect everyone and he is ruining it!!!!!!!!

I really hope we get these payments because there are so many desperate families out there that need this helping hand. Why would one man want to stop millions of people being helped? Now that seems un constitutional if you ask me and immoral!!!!!!!!!

If the actual tax payer misses out the $900 what happens to the people who have already been paid???? They should be made to pay it back !!!! It's just not fair - why are they so against the working class????

I hope he does win, so that money can go to the battling tax payers instead of those who don't.

Could someone give me Mr Pape's address. If his challenge should succeed, I'd like to bill him the $1800 my wife and I are relying on as part payment for our new bath room which is already being renovated.

Stopping these payments will cause a lot of problems for huge numbers of people, and as already mentioned, the people who have received the money should pay it back if the rest of us don't get it. It's unfair to give it to one group and not whole group. Rudd promised these payments, now he should deliver. He is happy at the moment because his ratings are up - well if he doesn't deliver he won't be so popular will he. His popularity vote depends an awful lot on these payments going out to people and families.

Clearly this man has nothing better to do. Are tax payers footing the bill for him to find out whether we, as the taxpayer, should be getting the $900 stimulus payment? Go and prosecute a criminal and stop wasting the entire nation's time Mr Very Unpopular.

Isn't it obvious......... this goose must earn over $100,000 and therefore he won't get the $900. He is acting like a spoilt child. I bet he doesn't have to worry about bills when they come in or schools wanting more and more money the list goes on. He obviously spends his sleepless nights (if he has them at all) thinking up ways to make it harder for people who don't earn the big money....................
